Terms of Use
These terms are an agreement between you and Darvish Consultants ("we", "us"), the operator of SOLIT Simulator (the "Service"), available at https://www.solitsimulator.com/ and https://app.solitsimulator.com/. By creating an account, signing in, or ticking "I agree" in the Service, you accept these terms, the Refund Policy and the Acceptable Use Policy. If you use the Service for an organisation, you confirm that you may accept these terms for it, and "you" includes that organisation. If you do not accept them, do not use the Service.
1. What the Service is
The Service is an engineering software tool. It produces predictions of how a water-mist or deluge system might perform in a tunnel fire test: a reduced-order calculation and, on request, CFD simulations run on rented cloud machines. It is offered as a beta and changes over time.
2. What the Service is not
Every result is a prediction from a model, not a measurement, not a test result, not a certificate and not an approval. In particular:
- It does not replace a full-scale fire test. The SOLIT² test protocol itself says CFD shall not replace full-scale testing.
- It does not replace the judgement of the authority having jurisdiction, the project's fire engineer, or a qualified engineer's independent review.
- Results depend on the data you enter (nozzle data, design values, limits). We do not check that your data is correct, and a result is only as good as it.
- The model is calibrated against published tests and is not validated for every system, tunnel or fire; the Service says on screen and in its reports where a result rests on estimates.
- SOLIT Simulator is not affiliated with or endorsed by the SOLIT² project.
You are responsible for every decision you make with the Service's output, including design, procurement, bidding, testing and life-safety decisions, and for checking any result independently before relying on it.
3. Your account
Accounts are for named individuals and are approved by us. Keep your sign-in details and second factor secret, do not share your account, and tell us at once through the support form if you think someone else has used it. You are responsible for what is done with your account.
4. Your data
You keep all rights in the designs, data and files you put into the Service and in the results it produces for you. You give us a licence to store, process and display them only as needed to run the Service for you, to keep it secure, and to meet legal duties. We keep them confidential, we do not sell them, and we do not use them to train any model. You confirm you have the right to put into the Service any data you put into it, including data that belongs to your clients or suppliers.
5. Fees and credit
Using the reduced-order calculation is included with an approved account. CFD runs on cloud machines are paid from prepaid credit, at the prices shown in the Service when a run starts; the price of a run is fixed when it starts. Credit is bought through our payment processor, Razorpay, and is governed by the Refund Policy. Taxes, where they apply, are shown on the invoice. We may change prices for runs that have not started.
6. Acceptable use
You will use the Service lawfully and as the Acceptable Use Policy describes. We may suspend an account that breaks it.
7. Our property
The Service, its software, models, calibration, documents and design are ours or our licensors' and are protected by law. These terms give you a right to use the Service, not ownership of it. If you send us suggestions, we may use them without obligation to you.
8. Other providers
The Service relies on others, including cloud hosting, the Fire Dynamics Simulator (FDS) software, email delivery and Razorpay for payments. Their services are subject to their own terms, and we are not responsible for their failures beyond the refunds our Refund Policy gives.
9. No warranty
To the extent the law allows, the Service and every result are provided "as is" and "as available", without any warranty, express or implied, including of accuracy, fitness for a particular purpose, merchantability, non-infringement, or that the Service will be uninterrupted or error-free.
10. Limits on our liability
To the extent the law allows:
- we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, contracts, bids, business, data or goodwill, or for the cost of tests, redesign or delay, however caused, even if we were told it was possible;
- our total liability for all claims arising out of or relating to the Service or these terms is limited to the amount you paid us for the Service in the twelve months before the event that gave rise to the claim.
Nothing in these terms limits liability that the law does not allow to be limited.
11. Your responsibility to us
You will defend and compensate us, and the people who work for us, against claims, losses and costs (including reasonable legal fees) arising from your use of the Service, your data, any reliance on results by you or anyone you share them with, or your breach of these terms.
12. Suspension and closing an account
You may stop using the Service at any time. We may suspend or close an account that breaks these terms, that puts the Service or others at risk, or that the law requires us to act on. Unused credit on an account we close for a reason other than your breach is refunded as the Refund Policy says.
13. Changes
We may change these terms. When we do, we publish the new version here with its date, and the Service asks you to accept it before you continue. A change does not apply to a run already started.
14. Law and disputes
These terms are governed by the laws of India. The courts at Palakkad, Kerala, India have exclusive jurisdiction over any dispute arising out of or relating to them or the Service. Before going to court, contact us through the support form and give us thirty days to try to resolve it.
